wir begrüßen Sie herzlich in unserem 3D-Tool Digital Twin Station Berlin und freuen uns über Ihren Besuch.

Durch unser 3D-Tool besteht für Sie die Möglichkeit, die von uns virtuell bereitgestellten Räume im Rahmen einer sog. 3D-Tour virtuell zu betreten und anzuschauen. Die Bewegung durch die so angebotenen Räumlichkeiten erfolgt durch einfache Steuerung mit der Mouse.

Dieses 3D-Tool ist kostenlos und unterliegt den folgend dargestellten Nutzungsbedingungen und dem nachfolgenden Haftungsausschluss:

1. Funktionen
Unser 3D-Tool gibt Ihnen neben der Möglichkeit, Räumlichkeiten virtuell zu erfassen und zu durchschreiten.

Mit Log-In haben Sie die zusätzliche Funktion, an jeder Stelle des virtuellen Rundgangs durch entsprechenden Mouse-Klick-Befehl sog. „Point of interests“ zu setzen und diese mit einem Kommentar oder einer Frage zu versehen. Die Sichtbarkeit dieser Kommentare kann dabei nur für den kommentierenden User selbst oder aber auch für „everyone“, also für jeden eingeloggten Nutzer, eingestellt werden.

2. Kein Abschluss eines Vertrags oder eines Vorvertrags
Durch das Nutzen des 3D-Tools kommt kein Vertrag oder Vorvertrag zwischen Ihnen als Userin / User und uns zu Stande. Wir haben insoweit keinen Rechtsbindungswillen. Erst bei weiterer Kontaktaufnahme mit uns bei Interesse an einer Räumlichkeit kommt es ggf. zu einem vorvertraglichen Status, in dem dann über die genauen Abmessungen und die genaue Ausstattung der Räumlichkeiten gesprochen wird.

Bitte beachten Sie, dass unser kostenloses 3D-Tool lediglich dem Zweck dient, Ihnen einen besseren Eindruck von den Räumlichkeiten zu verschaffen. Die genauen Abmessungen und die genaue Ausstattung werden aber erst bei Abschluss eines Vertrags festgelegt.

3. Haftungsausschluss
Wir übernehmen keinerlei Haftung (Ausnahme: arglistiges Verschweigen oder Vorsatz) für die Richtigkeit, Vollständigkeit und Aktualität der Messdaten und / oder der Ausstattung, die Sie bei einem 3D-Rundgang erhalten.

Wir raten daher ausdrücklich davon ab, lediglich aufgrund der 3D-Tour im virtuellen Raum reale Werkstücke (z.B. für eine Messe u.ä.) anfertigen zu lassen.

4. Kommentarfunktion
Hinsichtlich der Möglichkeit der Einbringung von Kommentaren bei sog. „point of interests“ behalten wir uns vor, Einträge, die offensichtlich gegen geltendes Recht verstoßen, ohne weitere Rücksprache mit dem User zu löschen, um uns auch vor Ansprüchen Dritter zu schützen. Ebenso behalten wir uns zugleich auch vor, den entsprechenden User zu sperren und den Account zu löschen.

Hinsichtlich der Kommentarfunktion gelten dabei insbesondere folgende Regeln:
- Es ist untersagt, Inhalte zu veröffentlichen, die einen Straftatbestand oder eine Ordnungswidrigkeit erfüllen.
- Es ist untersagt, Inhalte zu veröffentlichen, die rassistisch, diskriminierend, pornographisch oder beleidigend sind.
- Es ist untersagt, die Kommentarfunktion zur nicht mit uns abgestimmten Platzierung von Werbung zu nutzen.
- Es ist untersagt, über die Kommentarfunktion Spam zu verbreiten.
- Es ist untersagt, die Kommentarfunktion für wettbewerbswidrige Handlungen zu nutzen.

Our 3D tool gives you the possibility to virtually visit and view the rooms we provide to you in the context of a so-called virtual 3D tour. You can move through the rooms by simple movement of the mouse.

This 3D tool is free of charge and is subject to the terms of use and the disclaimer set out in the following:
1. Functions and features

Our 3D tool, besides allowing you to virtually detect and move through the rooms, offers the following additional features:

When you log in, you can use an additional feature by which you can set a so-called “point of interest” at any point of your virtual tour by a simple mouse click and you can add a comment or question there. You can choose the settings either such that the comments are visible for the commenting user only or for “everyone”, i.e. for every logged-in user.

2. No conclusion of a contract or precontract

When you use the 3D tool, this does not involve the conclusion of a contract or precontract between you as the user and us. We have no intention to create any legally binding relationship between you and us at that point in time. Only if you decide to contact us because you are interested in any of the rooms, a precontractual situation may arise where we may talk about the exact measurements and the specific equipment of the rooms.

Please be aware that our gratuitous 3D tool is only meant to give you a better impression of the rooms. The exact measurements and the specific equipment will only be determined upon contract conclusion.

3. Disclaimer / Exclusion of liability
We accept no liability for the correctness, completeness and currentness of the measurement data and/or equipment data which you are provided with during the 3D tour (except in the case of fraudulent concealment or deliberate acts).

We explicitly advise you against having real parts, components or other equipment (e.g. for a fair or the like) manufactured solely on the basis of the 3D tour through the virtual rooms.

4. Comment feature
As to the possibility to add comments at the so-called “point of interest”, we reserve the right to delete any entries that obviously contravene the applicable laws without consultation with the user, also to protect us from third-party claims. We also reserve the right to block the respective user and delete his/her account.

The use of the comment feature is subject to the following rules:
- It is not allowed to publish contents that fulfill the elements of a criminal offence or administrative offence.
- It is not allowed to publish racist, discriminatory, pornographic or offending contents.
- It is not allowed to use the comment feature for posting advertisements without our prior consent.
- It is not allowed to distribute spams via the comment feature.
- It is not allowed to use the comment feature for anti-competitive actions.
